False positive HIV test, do I have a case?

My clinic lab messed up the results on my HIV test, telling me that I have HIV, when after numerous appointments and tests found out that I don't, and it was a lab error. I spent 3 weeks of my life believing that I was HIV positive. Should I look into an attorney to sue them for putting me through that? Do I have a case here?

Nope. The HIV test, if done correctly, will occasionally give false positives even without lab error. EVERYONE makesmistakes sometimes. It's impressive trhey were able to confirm you didn't have HIV in only 3 weeks. Medical malpractice case take a lot of "leg work" to prove. If you have no physical damages (injuries, physical pain, lost wages) the damages would be minimal, and likely not worth a lawyer's time.

well, there are many pros and cons of suing the clinic, hiring an attorny does cost money and if you dont win the case you would lose money, or if you dont get much money back if you win you could lose money by getting less money than you paid your attorney. A lot of people make tens of thousands of dollars off of suing big companies for something they found in what they bought from the company (ex. finding a toothpick in their soda, or slipping on a grape i a grocerie store and being injured) and stuff like that. but they pay big money to the victim just because they dont want bad publicity. the clinic may do the same but they may not realize that or they may not be smart enough. but if you do deside to sue the clinic, you probably would make a good amount of profit. so i would do it. (i wrote the whole paragraph so you would know the dangers of suing)

I would . You can sue them for male practice. I would based on the fact that you will probably have that in the back of your mind for the rest of your life a part of you might all ways believe that you are hiv positive. And now your probably get tested all the time do to the fear they in staled in to your thought process.

yes it sounds like you do have a case. i would definitely take legal action. that is a big thing to tell someone they have when they don't. i can't imagine how emotional that may of been. good luck to you! and i'm glad your test was really negative.

oh wow...hellll yea i would do that immediatly thats ashame..cause you had to go threw all of that feeling like **** wandering what you could have done wrong...then they say opps sorry my bad..hell naw i would get a lawyer immediatly...good luck!!!
